Can you dispute a will you deem unfair?

Is it possible to dispute a will you deem unfair? Here are a few things you might want to know.

 

A will might be invalid:

• Not executed properly (signed and witnessed)
• Lack of capacity to make the Will
• Undue influence
• Fraud or forgery

If the Will is valid, certain relatives and dependants may challenge the division of the estate under the will:

• This may be possible under the done under the Inheritance (Provision for Family and Depenadants) Act 1975.
• You must act quickly.
• You have 6 months from the date of the grant of probate within which to issue your claim at court.
• Apply for caveat to protect your position, if probate has not yet been granted. This will prevent probate being granted thus allowing more time to bring a claim.
• Seek Legal Advice immediately.
