Holidays – What are my rights?

I am abroad now

At the time of writing, the Foreign and Commonwealth Office (“FCO”) strongly advises you to return home now and the FCO is currently attempting to charter and/or arrange flights to repatriate those who have been unable to arrange a scheduled flight.

If you have COVID-19 symptoms [info graphic], follow the advice of the country you are in.

I was thinking of going on holiday later this year

At the time of writing, the FCO strongly warns against all but essential travel and this includes the UK which is currently under “lock-down”. Booking any travel at this time could be extremely risky and you won’t, at the moment, get any insurance cover for Coronavirus. We would suggest that until the situation is clearer, it would be very risky making any travel arrangements.

I have been on holiday and I now have the Coronavirus, can I get compensation?

If it was a package holiday, then your tour operator is responsible. You would have to prove that the hotel or any tour organised by the tour operator failed to take reasonable measures to ensure your safety. In other words, do they sanitise areas, isolate un-well guests, etc.

However, let’s be honest, it is going to be really difficult to prove that it was just down to the hotel or tour given how fast this virous as spread and how it has caught Governments out. We think tour operators are going to get a lot of sympathy except in the clearest of cases [but we do offer a free 15-minute consultation; if you do believe you have a claim, please use our contact form below].

More importantly, if you have just got back from holiday and are suffering from the Coronavirus, click this link to the NHS https://www.nhs.uk/conditions/coronavirus-covid-19/ on what you should do.
